Im from arizona my husband was charged with a 3rd degree burglery. He was not involved but was at the scene. He is pleading not guilty. He had court a few times judge mentioned the lack of evidence in the case they even lowered his bail. Well he had court today and I looked up the case info and it said dismissed due to a grand jury indigtment. I researched for hours to see what that means I have gotten so many mixed definitions. He is still in custody due to a violation of probation but does that mean the burglery charge was dismissed.?? I looked up minute entry and its unavailable. ????

Typically after being charged a defendant has a preliminary hearing. At that time a judge decides if there is enough evidence to hold over for trial. Sometimes the prosecuting attorney will dismiss the charge and bring it by direct grand jury indictment so that it does not go in front of a judge until trial.
