Default Discharged BK of one spouse

If one spouse only (husband) files Chapter 7 BK and it is discharged, is the other spouse (wife) responsible for debts the two have together? ( i.e. a house in Arizona that had the 1st and 2nd mortgages discharged; however, the wife's name was on the second mortgage only (not the deed or the first mortgage). Is she still responsible for that 2nd mortgage even though it was discharged in her husband's BK and the home is in a community property state?

I can understand this is a frustrating situation for you. I suggest you speak to an attorney to determine the various obligations and protections between the two of you and the creditors - these matters can be tricky and a lot depends on the kind of bankruptcy petition filed, the terms of the discharge, whether there are repayment obligations, etc. You can find an attorney through the locator service on LawInfo's home page at: http://www.lawinfo.com.
