Default Disability income & Social Security

I am 100% disabled living on SS & SSI. I am being sued by a private creditor for a debt (allegedly) I incurred before my disability reached a level at which I could not work. I own no real property and only the modest bare necessities of life. I have no savings. Can a judgment against me should such occur cause my SS or SSI disability income to be attached or otherwise taken from me by the private creditor? bishop17@mindspring.com

Default Social Security Garnishment

My sole income is Social Security Disability! Before I was awarded S.S.I. benifits I attempted to go To Devry which I dropped out of ! I was led to believe that the student loan would be returned to the government! It wasn't ! Now 25% of my social security is being garnished for a Student Loan that I never used! Is there anything that I can do?

United States Code TITLE 42 - THE PUBLIC HEALTH AND WELFARE CHAPTER 7 - SOCIAL SECURITY SUBCHAPTER II - FEDERAL OLD-AGE SURVIVORS AND DISABILITY INSURANCE BENEFITS U.S. Code as of: 01/05/99 Section 407. Assignment of benefits (a) In general The right of any person to any future payment under this subchapter shall not be transferable or assignable at law or in equity and none of the moneys paid or payable or rights existing under this subchapter shall be subject to execution levy attachment garnishment or other legal process or to the operation of any bankruptcy or insolvency law. (b) Amendment of section No other provision of law enacted before on or after April 20 1983 may be construed to limit supersede or otherwise modify the provisions of this section except to the extent that it does so by express reference to this section. (c) Withholding of taxes Nothing in this section shall be construed to prohibit withholding taxes from any benefit under this subchapter if such withholding is done pursuant to a request made in accordance with section 3402(p)(1) of the Internal Revenue Code of 1986 by the person entitled to such benefit or such person's representative payee. /s/ Thomas L. Default social security disability

I am 100% disabled with multiple sclerosis and recieving social security disability I was told that this income can be garnished by the state of mass although a recent posting led me to believe that it couldnt be I have no assets and my only income is ssd so its imperative that I know what the answer is please advise thanks in advance

Default repayment of benefits

We recently were granted a retroactive award from social security. Can the LTD insurance company claim that that entire award be paid back to them including the portion allotted to my dependents?

Default prior child support payments

my ex keep trying to prove that i didn't make my child support payments from 1999 to 2001. when i became disabled in 1999 the social security admn began sending her child support payments from my social security. i am trying to get the social security office to send me a record of all the payments made to her but they said that they couldn't only my ex could do that since she is my daughters representative. is it anyway i can request this info from the child support office or social security office by using the freedom of information act or please suggest another way for me to get this information.

Default eligibility

I am applying for CA Disabilty. Can I receive SSI beneftis as well? What if I am receivng Unemplyment Insuarnce..do I have to give that up. What are the issues involved in getting approved for SSI disability? I am also receiving my deceased husband's social security. Does that go awy if I am approved?

I have a lawyer on my appeal. But I don't know what my chances are. Do you have any way of knowing what chances a person has based on their medical conditions?? Mike T.

Default Garnishing social security disability

In a word NO!! These ss disability funds cannot be garnished for unsecured debts. Also creditors cannot harass you. Search Jerome Lemet for more details.
