Default Denton County Court vs Norwegian Supreme Court

A divorce filed in Norway 09/98 under case no 1998/12329 petition of divorce served 01/99 to party in Denton Tx settlement of assets 01/99 thru 04/99 between parties Separation License issued by Norwegian Governors and accepted by both parties 06/99 with divorce to be granted in 12 mths 08/99 party in Denton files a second petition of divorce in US 09/99 files appeal in norway to move the divorce case from norway to US appeal is raised from norwegian state court to norwegian supreme court 12/99 norwegian supreme court judgment (case no. 00-00660 K/04) handed down 03/00 with decision norway was the prevailing law in the matter and divorce should proceed accordingly 04/00 divorce case no. 1998/12329 resumed under norway law 06/00 divorce decreed as final between parties by norwegian department of justice. US party dismissed their norwegian attorneys and assisting US attorney 04/00 US party retained new attorney in Denton Tx and resubmitted petition for divorce in denton county court 05/00 US petition was never served to parties in norway and Denton county court under cause no. 99-50634-367 passed a default judgment on the party in norway and awarded all assets of the parties to the party in the US and granted a US divorce 06/00. The divorce was not made known to any party outside of denton county and only became known a year later when impact to the assets of the norwegian party was discovered. The norwegian divorce proceeding were registered and recorded in 09/98 by both parties. The process of the norwegian divorce followed due course of norwegian law and was accepted by both parties. The US divorce was filed 08/99 and presented only in an appeal to the norwegian court. The US court was notified of the existing divorce proceedings and was on file. The impact is double jeopardy on the norwegian party through award of assets after provisions were agreed and conducted under norwegian law between the parties. What laws in the US pertain to double jeopardy in relation to internation status? Does the US Denton County Court have the legal position to disregard the notice of a norwegian divorce and to proceed with a US divorce over ruling a national supreme court? Does the US District Court in N.O. La. (CA No 02-0791)have the authority to make a declaratory decision on the rights to the assets as to award based on the Denton Tx County Court or the Norwegian Supreme Court? As the norwegian parties are unfamiliar with US law a request to the US District Court for legal representation was made and rejected by the US District Court and will now come for decision on 20 August. What are the legal issues and positions here and what recourses would be available?

Default Need to Research

I have no clue and would be afraid to venture a guess. Yours is a complicated problem involving legal issues for both State Federal and (maybe) International Law. You'd be well-advised to pay an attorney for two or three hours of the attorney's time in order to properly research the matter. You may call us at 972/380-8000 if you'd like to hire us to research this matter. Rita M. Boyd Attorney
