Denied SSID because I am educated
Hi All (new member)
I have been denied SSD because I am self-educated and received a JD during my disability. I am Manic-Depressive, have anxiety, agoraphobia and PtSD and studied during my manic phases and did nothing during my depressive phases. Somehow i was able to keep schedule, but missed a couple of testing deadlines. The school was a diploma mill and is now the subject of a fraud action with the CA state Bar and the Postsecondary School Association of CA. I never received my diploma. BUT the whole premise of me not receiving DIB is that i achieved my 4yr degree in Law despite my disability. I posed the following question to the court - does my education and ability to learn preclude me from disability (see SSR 83-15 which says "No"). Since the rigors and politics of a true work environment is something I cannot handle given the up and down mood swings that I have. I am unable to grasp and remember things in my depressive state. After 8 yrs I am still not stable on my meds. I am in Fed appeals ct now and have been waiting on a decision for about 2 yrs now. There was no VE or mention of any DOTs that shows what work I am able to handle. I also have sit/stand issues in that my anxiety doesn't allow me to stay in one place for too long (maybe 45 min at the most). The ALJ didn't discuss this at all. An atty friend sent me a listing of what ALS are the worst and mine was one of them - he had a 45% denial rate, and the court rubberstamped my denial strictly based on my education, and not my medical history. Anyone else have this problem?? Does anyone educated in the field know of the chance of a reverse and remand in this situation?
Jackie
