Default Delete Bin Did They View

I am trying to find out about a case in Florida that says that child porn was found in his delete bin so there was no crime, because he did not save, file or download. They blamed it on pop ups or spam well to me as a pretty well versed in computer information. The only way that anything can get into the delete bin or recycle bin, be it a pop up or whatever one would have to open the site and then place it in the delete bin. Not sure but if a person opens and views the site that is the same as downloading, saved or files and that it was done "KNOWLINGLY". Sure would like some help on this if anyones knows.

What if it is an email the doesn't describe what the site is and you click on it and get brought to the porn?

The police found more than 50 porn sites that were visted on a certain day. But when they found the child porn on there and images it was put in the delete bin. I am just asking how can it get into the delete bin if it was not open. It was not in junk mail it was on the HD.

I really can't answer your question. I am sorry, I am not sure. There may be some other issues at play here as well. The district attorney who handled the case may be best to answer you.
