Default deferred judgement

Hello,

Several years ago, I got caught up with one of my friends when he was shooting out windows on construction equipment with his bb gun, and got arrested. Since I was with him, I got charged as well. The charge was 4th degree criminal mischief, which is a class D felony, considering there was roughly $4000 worth of damage to the vehicles. I pled guilty to the charge, and because I had no prior criminal history, I was sentenced to three years probation, for which I have successfully completed. Although I have completed probation, I still owe approximately $2,000 in restitution. I have two questions: Since it was a deferred judgement, would the case be removed from my record after probation or once the restitution is paid, and if I am applying for a job, would I be ok to say no, if asked do I have a criminal record? Thanks.

You need to re-pay the amount owed before anything; this was part of your sentancing agreement.

Before anything hapens you need to repay your restitiution. Were you given a court date to come back and show that you had comnpleted everything? Were you told that the charge would be dismissed if you did everything?

Default Concerning the Job

You are making a deal that basically says pay your fines and court fees and complete probation and in exchange they will defer your judgment so it will appear to anyone looking at your criminal background that your charges were dismissed. Until the deferment is granted it may show up on your record. After your deferment is completed you have the right to answer "NO" to that question on the application.
