Default Daycare contract broken

I run an in-home daycare and recently received a call from one of my parents stating that her son will no longer be attending daycare in my home. My contract states that 2 weeks written and paid notice is required to terminate enrollment. I reminded her of this, and have not heard from her since. She also owes me $50 from the last week her son was in my care. Being that I never got written notice from her, does she still owe me just the 2 weeks plus the $50? Or has her two weeks not even started (because she never gave me formal notice)?

I'm looking at taking this to small claims court, and want to make sure I have my figures straight. I also have a $5/day late fee (including weekends) stated in my contract. This would definitely apply to the $50, but does it also apply to the 2 week notice period as well?

You can request for whatever damages you believe are appropriate, the court will decide which to award. But if you don't ask, the judge won't say, "Hey, you are also entitled to...." That is why most people ask for the total damages they might recieve, based on some legitimate logic.

"A contract is a contract". If you really feel that she still owes you money, you can file a case.
