Default custody issue

Okay, I've been divorced for a few month. Seperated for 3 years. We have 4 children, 3 minor children. Issue: my ex-wife is seeing a man who has had custody of his children taken from him because he got a DUI and had his kids in the car at the time. His ex-wife got an ex-parte order against him.

I am a little troubled that my ex-wife would expose my kids to this. What can I do? I would like to make sure my kids are not in this guy's presence. FYI- it was his 2nd DUI in 1 1/2 years.

Her dating him isn't likely to bother the court, and courts don't alter custody for being in the "presence" of people with DUI convictions (sex offenses against children, yes, DUI, no). If she marries him, or if you can show that she's got him driving the kids around, THEN you have potential ammo with which to seek custody. Until then, the courts will presume that if she's the mom, that SHE bears the burden of not allowing the children to be driven around by a person who is impaired (if he's not impaired when driving, he's doing nothing wrong).
