Default Custody help please.

I am 16 years old and my sister is 14. My parents are currently going through a divorce. I am traveling to friends' and family's houses with my mom. My dad used to drink, smoke, and watch porn -occasionally letting my sister and I see the porn when we walked behind him, looking at it on his laptop. He used to smack me in the face when I was young, because I wouldn't eat. The reason we left the house is because he came barging into my room because I had closed the door. I didn't slam it or anything bad. When I asked him why I was supposed to leave the door open, he asked me if I had done my school work. I responded with a no, because I was putting it off until the break was almost over, so I could relax. He got extremely angry and picked up my TV and began to drag it away. I got up from my chair and started yelling at him, calling him crazy. He started throwing punches and my sister called the police while my mom held him off. This is the second time he has gotten into a fist fight with me. It is also the second time my mom, sister and I have left the house. The first time, we spent the night in a hotel and returned home the day after. We don't plan on going back this time. I do not want to live with my father at all, ever. I took a picture a while back of him passed out on the kitchen floor and sent it to all my friends to get a good laugh out of it. Nobody has this picture anymore, not even me, but they did see it. I also have a picture of our outside garbage can filled with beer cans. He didn't have a party. Is there any way for my mom to get full custody, somewhat easily? Can I ask the judge to live solely with my mom? What can we do?

Your mom needs to speak with an attorney. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
