Yes. Anyone can sue anyone else for anything. Any established parent has the right to ask the court to evaluate if and at what level custody or visitation is appropriate and to further ask the court to issue an order spelling out any rights the court might deem appropriate. Suing doesn't mean WINNING, however. If custody would actually be ordered depends on a great number of factors, none of which are available to us to evaluate.
