Default What constitutes an illegal detainment?

My husband and i shopped in the same Publix for 4 yrs. We loved the store and the employees and mangement and they loved us. Then a new manager came in and acted very strangely towards us. A bag of apples cost $3.00. For weeks we would get home and half the bag of apples would be rotten. We told the produce guy about it and he said that my husband could open the bag (it had a tie) and take good apples from another bag and he would throw the bad ones away. That made my husband very happy. One day i go to checkout and the manager comes running over to the register and asks the cashier to step aside and he took over i thought it to be very odd. He rings me up gives me my reciept and i leave. When i get outside the manager and a security gaurd jump in front of my cart it scared the life out of me..They said to my husband to go back inside. I said what is this all about? They said that we know what it's all about. I said that i had not a clue what it was all about. They insisted we go back inside..so not to be embarrassed any longer we did. They took us in the office and said they were calling the police because my husband put 2 more apples then should be in the apple bag. I said are you for real? I have a reciept that you gave me. My husband was so freaked out. He said ok well then can i pay you for the 2 extra apples or just give them back? He said I did not steal them i just wasn't aware of it. They said no. They said if my husband paid a $300.00 fine they wouldn't call the police. I said are you ppl crazy? Call the police!!! I have a reciept!!! My husband didn't want to make anymore of a scene and was just mortified. They took his picture and his ID and told us we were banned from the store. I later spoke to a cop who is a personal friend and he said they were totally in the wrong and if we had of called the police they would have said that we had a receipt and that was that. Not being able to shop at that store has been a huge inconvience for us as it was just 3 mins from our house. Plus the mamger told all the employees about it as we were told by some of them and some see us in a different light as tho we were criminals. We have never in our lives committed a crime or been arrested. We want to sue Publix and the manager. Can we? Please help. Thank you.

Default If the police performed a lie detector tests my brother would not be in the situation he is in.

My brother at the age of 35 has been charged by the Hillsborough County Police Headquarters in Tampa Florida as a sexual batterer on a minor child. The child was 8 years of age at the time. Because there was no actual evidence of the crime being committed the HCPH in Tampa should have did a lie detector exam on him. They the police made a mistake. They didn't do a lie detector tests because they knew my brother was innocent. They had to clear themselves of the mistakes they placed on paper as to what happened when they arrived at the house where my brother was at the time of the arrest. He is now 45 years of age. He has been in and out of jail in the past 10 years. He needs help getting his case expunged. He has the rights to compensation by the state along with a public apology by the Governor. He has suffered permanent damage of pain and suffering. He is residing in a transitional house with other sex offenders. Recently as he was attempting to bike to a neighboring store 3 young men beat him up real badly and stoled his bike. My brother didn't deserve this. He is a slow developer (mentally and physically). He wouldn't harm a fly. He needs to get out of that neighborhood for his own good. He didn't commit the crime he was charged with. He needs to be with family but the state said he couldn't live or work near anyone under the age of 18. He is on probation for 5 years. The accuser lied about my brother messing with one of his children. He did this because my brother was a witness to the accuser's stabbing and rape to his own wife. He didn't want to go to back to jail. My brother tried to tell him that his children were caught by him messing with each other in a sexual manner. My brother tried to stop them. The accuser took this story that my brother tried to tell him and turned it around making my brother a sexual batterer on his eight year old son. The police harassed my brother threatened to beat him and keep him in jail if he didn't write a confessional note about the incident. My brother was alone scared hungry and tired. He didn't write that well at the time but he was told to write down what the police told him to. He spent 8 months in jail before his trial date. The child couldn't remember what he told the courts 8 months prior so eventually the case was dropped. The written confession is what caused him to get into further trouble with the courts. So he spent 5 more years in jail. He wasn't residing at the place (which was his other brother's house) the address registered with the state due to the fact that he needed someone to help him during his recovery time after having shoulder surgery. The police officer didn't listen to my other brother's reason why he wasn't at that address when the police were searching all sex offenders after the death of little Jessica. Now my brother can't reside with his other brother because he lives in a trailer and children under 18 reside there. We have spent so many years trying to get his case expunged. We need someone to help the indigent in this matter. We don't want him dying one day and have him titled a sexual batterer. If you knew him you know he wouldn't do anything wrong to anyone. He tries to help everyone and everyone likes him. I have written to a lot of attorneys innocense projects talk show hosts tv channel sites radio sites etc. trying to get anyone to hear his story and help him. The accuser should be in jail for falsifying his story about my brother. His wife supposedly left him after she was able to. The accuser has been charged with two past accusations. One was for threatening a witness and the other was for lying to the courts that sent an innocent man to jail. The accuser had a real mean attitude. He took advantage of my brother (who worked and lived with the family for six years) beat and humuliated him all the time and his children also beat up on my brother pretending that they were only playing. My brother is 5'10 but only weights 125 pounds. These children were close to that weight themselves when my brother was arrested back in 1997. Please anyone reading this contact me and lets get my brother freed from papers for good. Thank you audreycsmith@verizon.net
