Thumbs down Homeq=Predatory, Deceitful & Stressful

When I typed in Homeq complaints for a search this site never came up. It was there today and listed second. I have read all of your comments and experiences. What kind of servicing company are we dealing with here, gang? My experiences are very current and my dealings with them go back to 2/06 when they started servicing my mortgage. To make this somewhat short I have been sending them approximately $3000 since 8/06. Sometimes more and sometimes less, but nothing less than $2844. There have been times that they have told me that I didn't have to send a payment the following month or I had enough built up for two payments. To my astonishment, I would get calls saying otherwise. I did get behind when they first took over as my previous mortgage holder didn't receive my payment in the process of the transition. And I have never received the check back and it as well has never cleared my account. I have missed a payment within the last year as well due to depression and just didn't care at the time. My regular payment was $2142 and then changed to $2346. Never receive statements or billings. I haven't sent a regular payment in months as they would always call and tell me what to send and I would. They put me on a payment plan with no grace period and eventually was only allowed to send Western Union which I did. I sent them $4700 5/07 and then $2844 6/07, 7/07, 8/07 and then called them and informed them that I could no longer send that amount due to me no longer working but could send the regular payment which we could afford with my spouses income. I gave the gal all of our information and she informed me that she would get back to me. Well, she got back to me the next day to tell me that they couldn't work with me as we only had an extra $79 to send in addition to the payment. She told me to get some people in to rent out rooms in our house to help with the payment. Whatever!
I told her that we wanted to put the house on the market to downsize with a goal of not such a large payment. Her comment was that I still needed to come up with the $2844. Nice. I asked her about a short sale and she told me to look on the website. She could not even explain to me what it consisted of. I went to the website and it doesn't explain it to you, they just have the forms for one. My spouse said that it's to the point where a person doesn't care anymore what they do and they can have the damn house. At the same time it's not the route we would like to see conclude in our dealings with these people. They need to be corrected ASAP.
I have been on the phone with four different people in the last week and nobody tells you the same thing or provides you with the same information. I was told a week ago that I had over $1700 in my account after asking about all the money I have been sending. On 9/14 I seen on my phone that they had called so I called them back. That's another thing...they always call but never leave messages. I would guess that's intentional. Especially for those that don't have caller ID. I got to talk to a guy and he was very pleasant and we even laughed about something. How I was fooled again and you will read what unfolded from him being so nice. He informed me that I now had $1498 in my account and that I should send another $848. It would then be enough for a full payment that would be applied. He told me that I should go ahead and talk to my realtor friend over the weekend and get things going to list the house as we wish to do. He finally explained the short sale process to me after asking. He said that he would forward my file to loss mitigation and would make sure they knew that I was sending the balance to make a full payment. I asked him why they never leave messages when they call someone and his response was that they have various business practices. Huh? He couldn't explain it. I told him that seems like a strange business practice as there are people that don't have caller ID and others that have it who won't return a missed call or always check called ID if they have it. He could not tell me where my difference of the $1700+ and the $1498 went. If you look at your online account you will notice that it is very difficult to decipher the transactions and does not indicate any remaining balance. The last column is only indicated as 'other paid'. So one never knows what they have remaining after sending in such large payments on their so-called payment plans. And it's not necessarily going to your loan.
Here's what Mr. Nice Guy shared with me which nobody else has in the past 19 months. You will all be thrilled to hear this...when we send in the extra money for a payment plan, the extra funds beyond a regular payment sit in a 'SUSPENSE' account. At the end of every month if there are funds in your 'SUSPENSE' account they do a 'SWEEP' of all accounts if there is not enough there to apply a full payment. Those funds go to various fee accounts and if you pull up your account online you will see all these accounts such as, 'misc. other fees, other fees, statutory fees, misc. disbursement, late charges, other fee adjustment, repay of escrow, etc. But there is no explanation as to what they are for and when you ask they tell you they will transfer you to customer service and then happily forget to. I will be making a call to customer service in the morning directly.
So, I run to do a Western Union quick collect for $848 first thing Monday morning and wait for loss mitigation to call which he told me would be Monday or Tuesday, possibly Tuesday as they don't work weekends and they will need time to look at the file. As a few hours passed yesterday, I thought that I would pull up my account online and see if the funds were applied as a payment. I noticed that my due date hadn't advanced so I looked further. What the...on the same day that this Mr. Nice Guy told me if I sent that additional $848 and another payment would be applied with the funds in my 'SUSPENSE' account, they turned around and deceived me. He was only being nice to get me to send more money! There were six transactions done the same day for various fees using up the money he told me was going to be applied towards a payment. Now they have another $848 in my 'SUSPENSE' account to 'SWEEP' whenever they feel. Crooks and nothing but deceitful. I immediately called them and got this man who sounded as if he was around 70. I told him that I wanted an itemized statement of my 'SUSPENSE' account. He told me that he could provide me with a payment history. I told him that is not what I asked for and I can get that online. He said he could not provide me with anything on my 'SUSPENSE' account. I filled him in with what I was told to on 9/14 and that instead of a payment being applied, they used it on outrageous fees. He said that they do 'SWEEPS'. I said yes I heard about that but not until the end of the month. His response was, no we can do them anytime we want. He said, why would we not take money for fees instead if it is going into foreclosure on 10/19. I said what?! He asked me for the control number for the Western Union that I just sent and I replied, "I'm not giving it to you and the only thing I'm doing is calling my Attorney General and hung up the phone. I have asked for statements on account per phone and requested them online. I never see them. However, I did now receive a letter that I did not make my September payment so foreclosure proceedings could start. But...the last part of the letter states, if I would like to work on another alternative to please call. Huh! I have been talking to these people almost every day for over a week and do as they ask me to. They just lie and kick you in the gut.
Guess what? I have not heard from them since I told them I was calling my Attorney General. Which I did. The person I spoke with didn't understand why they can keep taking all these fees if a attorney has not been contacted and proceedings started. He requested that I fill out a formal complaint that I am working on. He also gave me toll free numbers to MN Commerce (another state would be different of course), Comptroller of the Currency, the FTC and a local foreclosure prevention counselor which I put a call into and should hear from tomorrow. So I will be doing a lot of paperwork but they stress doing it. I have spoke with my local credit union's mortgage person and they are shocked at what they are doing and have never heard of 'SUSPENSE' accounts and how they are handling them.
Well, we know why they call them 'SUSPENSE' accounts now, don't we? Leave the consumer in suspense!
I have also followed someone else's advice on here about a website of www.msfraud.com. What an awesome tool for us being fooled by mortgage servicing companies. On that web site I took advantage of sharing my story with their legal people as well. I'm suppose to hear back from them within 24 hours. It's time for we as the consumer to make sense of all of this and Homeq to provide us with some honest justification.

My home was taken over by homeq and I had no problems until I missed a payment and tried to get a them to work with me. They have acted as if they are going to help me , but I am no dummy!!!! I already anticipated this and is why I searched out for a forum. I have a home in Mich. where there are more foreclosed homes than there are ones in good standing( not really, but close). People have just walked away and abandoned them. Everyone here owes more than they are worth so they just leave if the mortgage companies won't help. The market is so depressed that you cannot get what you owe much less a profit. I will probably do the same if it comes to it. It sounds like the same result is going to happen, so why put yourself thru the misery.

I am in the same boat. If there is a lawsuit. I definetly want to join in.

I am inthe same situation. My husband lost his job last year and we have been trying to catch up ever since. We just worked out a last desperate plane to prevent foreclosure, and was told we have til 10/17 to make a 3200 dollar payment. My husband tried to western union 1200 dollars to them today. When the service clerk tried to run it, she couldn't saying that Homeq says to call them before making a payment. What kind of game are they playing. I don't understand this.

Angry predatory mtg company to add to the growing list

In late April I re-financed with Concord Mtg. and understood I had a 5/1 loan with a payment of 1573. When my first payment coupon arrived it stated across the top "this is an adjustable" mortgage and payment options started at 1585. which pays partial interest only. They have increased my interest rate 3 times in 4 months, transferred me to American Home mtg, then to EMC mtg. I did call the loan originater to find out what it was all about. He told me, "too bad you signed, I have to think about my own job and family". They are forcing me into forclosure, raised the principal amount owed by 500, just raised the 2nd option by 1,000 and I'm devastated. I have excellent credit and am about too lose everything I've worked for for the last 35 years because of this. Oh and since when is it legal for a notary to notarize out of the state their seal is from? Help!

I am not sure if there is a class action suit started, but someone has to be first. I would suggest contacting an attorney individually about your situations. He or she can research the issue to see if there are other suits out there that are similar. You can locate an attorney through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consultations. I do hope you can get everything worked out.

Default Homeq nightmare

I am here in Michigan. I too have had my share of horror experiences with Homeq. We fell behind in payments last June. On July 26th, we tried to make a payment for both June and July. Homeq refused payment stating they needed August payment too. On August 2, my husband called to make the payments for June, July and August. He was told they needed an additional $1200.00 for attorney fees because they'd started foreclosure proceedings. We sent the $1200.00. We checked our account the following day only to find that payment was not applied. When I called Homeq, they told me it was applied to our second mortgage and would be adjusted. When I questioned the foreclosure and how they could do that without notifying me they said they would adjust our accounts and apply the $1200.00 to our September payment and it would not adversly affect our credit report. I requested that in writing, which I did get. I immediately started applying for a new mortgage to refinance and get away from these crooks. When the new company ran my credit report, the foreclosure did show up. I sent the copy of the letter to the new mortgage broker. He tried to get Homeq to send him a letter stating the same thing. They sent him a letter verifying we were in foreclosure and the loan was reinstated on the 6th of August. Thankfully, the mortgage broker I was working with was familiar with these scam artists and did not give up on us. I called Homeq and asked why the contradictory letters. The could not answer and told me to fax a copy of my credit report and the orignal letter to their credit reporting department, which I promptly did on September 7th. For any correspondence, they say it's always a 7 to 10 day turn around time for results. On September 28th, I still had not heard from Homeq as to whether or not this matter had been resolved and the credit reporting company for our new prospective lender requested a 3-way telephone conversation to clear this matter up. At first Homeq stated, "yes, they were in foreclosure and the loan was reinstated on August 6th." I asked the woman about the fax I'd sent with their letter and my credit report. She put me on hold to check it out. When she came back to the phone, she apologized and said that was resolved on September 17th and was being taken off our our credit report. Very gratefully I say, we were able to secure a mortgage with a new company. We closed on our new mortgage on October 4. On Sunday, October 7th we got our first phone call from Homeq at 7:00 P.M. requesting payment for October. (so much for any grace period) We explained to them that we'd already closed on a new mortgage and they should have the payoff. The girl said she'd note that on our account. On October 10th, I received another phone call requesting October payment. I again explained that we had refinanced and were no longer with them. She said she was showing an October balance still owing. I asked her why it wasn't included in the payoff? She persisted to try to get me to set up a payment arrangement. I told her to stop harassing us and hung up. On October 11 I received yet another call to which I promptly hung up on. These people are rude and do not have a clue as to what is going on on any of their accounts.

Me And My Wife Got A Fixed Mortage Loan . Are Payments Were 718.00 Per Month We Recieved 1900.00 Per Month On Our Social Security. On June 17th 2006 My Wife Passed Away, My In Come Was 645.00 Per Month I Tried To Get Them To Lower My Payment At That Time I Owed 107,000.00 Now I Owe 119,000.00 They Keep Adding On More Interest I Moved Out In August Of 2006 I'm Renting A Two Bedroom House. They Have'nt Taken My House Back Yet They Wont Even Talk To Me On The Phone. I Just Got A Letter Today From Their Trott And Trott Stating I Had Untill March The First 2008 To Redeem It I Told Them They Could Have It Back When I Moved Out.

Default Homeq is a liar

Looking at several complaint board about HomEq, I noticed the complaints are almost exact. The bottom line HomEq is trying to scam anyone who has missed a payment.

If anyone knows of a class action suit against them, please e-mail me Nique_fleury@hotmail.com

In the mean time, I filed a complaint with the Fedeal Trade Commission. If everyone files a complaint with the FTC, HomEq will be on their radar. Hope this helps.

we are here in New Mexico, same story, same HomeEQ. We have filed for Chapter 13 because of HomeEq's aggressive increases and yet we still can't escape. We are now about to face foreclosure and who knows how many more legal fees by HomeEQ. It's nearly impossible to escape and we were woefully ignorant of what would happen-- all we wanted was to buy our first home and it's been a nightmare.

Does anyone have advice on how to walk away from our house without paying for it the rest of our lives?

I can understand tis is a frustrating situation for you. I suggest you try to speak to an attorney regarding your legal options.
