Clark V Astrue
I am a member of the current nationwide class action Clark v Astrue. Summary, SSA can no longer suspend benefits based SOLELY on a warrant for a alleged probation or parole violation.
My question is this.
I took care of the probation warrant that SSA was using to suspend my benefits and spent a month in jail while waiting for my turn in court.
The dispostion of the case was this. The judge did not find me guilty or innocent of the violation and "closed me out" on probation with no penalty for the warrant. I was allowed to leave the jail that day with no further probation. I was not found guilty or innocent and was just closed out.
Does this entitle me to backpay all the months SSA had my benefits suspended because essentially the charges were dropped?
The dispostion on the docket online says sentenced and not charges dropped but I am no longer on probation and owe the county no more time. The jails website shows my booking number and info and says I was released because the charges were dropped.
Any help out there that can shine some light on this?
