Default Child Support Question

I am the same dad that asked the question about the 12 year old daughter not wanting to go to her mom's overnight. I told my attorney that I didn't need her mom to pay any child support even though my attorney said she could probably be made too since she made the same amount as I did last year and our daughter is living with me all the time basically.

Will the courts allow her not to pay child support or will they step in and make her pay?

Child support isn't based on your NEED of the support, child support is ordered because the CHILD has the right to support from BOTH parents. If the support isn't necessary to maintain the child, then putting the money away for the child's college fund or an emergency nest egg or "yay, you're 18 and can get your own place fund" or other future benefit for the child is a good idea. You may not need it NOW, but a lot can happen in the next 6 years before she turns 18.

I understand. My attorney basically told me the same thing. He said there is a chance that we would get to court and the Judge would still order child support to be paid by her mom...even though we aren't asking for it. We did write into the settlement that since no child support was being asked for then I would receive the tax deduction for my daughter every year instead of alternating. Not sure any of this matters, cause the Judge may have a different opinion. We'll see.
