Default Child Support Arrears Tabs Suspension

Ok, I'm not disputing the fact that "they" CAN do this. My concern is two-fold:
  1. Due to surgery, I had to leave my former job and go self employed. This process takes some time to get going - mostly because of the catch up in bills - before all this my CS (child support) payments were AWD. It has been at best 6 months since my last recorded payment. Son turned 18 three yrs ago, so the CS was completed. However there was still a matter of arrears. This is why they are suspending my TABS renewal ability.
  2. Problem: My vehicle IS my job - and I still have much to catch up on (6 months of debt catch up) - I know I can call and make arrangements. Will they keep the same payments I had for the last 15yrs or can they change the monthly amount? Or is that total left to me? And if NO arrangements can be made, how can I make money to survive If I cannot renew my tabs?
  3. Now this is where I need the help of an attorney: Is there a legal code that states that as a payer - I have the right to see an itemized listing of WHAT IT IS that I'm paying for? I mean REALLY!! the tab is at 27k!!! My understanding is that arrears are benifits paid to the mother duruing the time the father did not pay. And during a time of minimum wage at $3.10/hr, I HIGHLY doubt I aquired that size of debt on the arrear!! So if there is money coming back to me because of this - I'll offer 50% to anyone that can fix this!!
This was an issue in Iowa. Kids still live there, so does the mom. I live in Minnesota. So I guess a BIGGER question is - Are the TAB renewal suspension only for IOWA or does it extend nationwide?

Kind Regards
Teeker

You ran up a child support tab for twenty seven thousand in six months?

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.

If i had control to "run up" a tab for 26k I would'nt have one at all.

children were born in the early 80's

but ya - you're just as confused as I am. If I paid my CS in full - and missed some in the early years? Doesn't add up. I've been paying on the arrears for 2yrs now so you can imagine what the original was.

Who is getting that money? Where are my receipts? What am I paying? How can I get this lowered. They never got it in the first place (kids told me - they were led to believe I paid nothing until I showed them all my check stubs with the AWD for all those years, of course they WERE'NT surprised. )

I am confused because you are contradicting yourself. Example: "If I paid my CS in full" is followed by
"Missed some in the early years". Have you always paid your child support? If your ex wasn't receiving it, why didn't she notify the court and ask for the money?

Child support payments, especially those automatically deducted, would be on record with the court. Is your ex stating she never received the money? Or did you, at some point, stop paying ( I believe that's what you said happened when you began working for yourself). You do not get an itemized list of what the money is spent on----food clothing, shelter, utilities, medical bills, etc. The custodial parent, I presume, paid 100% of those costs in those times you were, for whatever reason, unable to pay. Therefore, she/he is entitled to be repaid. Also some states collect and pay themselves back for those times where the custodial parent has to go on public assistance.

Is your ex receiving your money?

Thank you for the replies -
I have an attorney working on it now - it made perfect sense to him.

Take care all

It probably made sense to him because he has paperwork in front of him, and doesn't have to guess at relevant omitted details.

Good luck.
