Child Custody
My divorce was final a year ago. We settled one split custody. The divorce went on for 2 years. My x husband lives with his parents has not had a job since we separated. Since the divorce he has not been able to provide for my kids...school supplies, hair cuts, clothes. He is on food stamps. My daughter is 7 and has been battling weight since the divorce. Her father feeds her what ever is the easiest AKA not healthy. His parents keep my children all the time and they have no rules my son has been to the emergency room 3 times since the divorce. My daughter tells me she wants to live with me and i want my children. I have my own place i have a job and have structure. I was married for 10 years and my daughter saw alot during our marriage. My X has 3 DWIs and was in rehab when we went through the first three months of the divorce....I know how did he get split custody right... money will get you anything. Unfortunatley i cannot afford to take him back to court with an attorney... I need help and suggestions please!

The only way to change custody agreement is throuogh court if you two cannot agree

Yes but its unwise to do so. Petition court for change and have Father served. Be prepared to provide any proof you have to validate your request

I have a GAL for my children. I cant get ahold of him till Thursday. I have called him on occasions before. He seems to think i should have the children also. Can he file something without me having to pay an additional attorney?

As I told you you can file for custody modification on your own but its not advised. What is GAL?

Gaurdian ad Litum...an attorney to represent my children to do what is in their best interest. Since my x husbands drug test came back clean and he is on probation. Their was nothing they could do but with this new information i think i may have a shot. The constant back and forth is not good for them. It is sad that its what money can get you not what is in the best interest of the child which is what i believe happened here. My X has called DFS on me 5 times now he is in trouble for harrassment and all of the caseworkers said that they should be with me that the back and forth is to much on the children and their father doesnt have a home for them just his parents house and his parents run a 24 hour daycare...seriously. But without proof of abuse or neglect there is nothing they can do.

do not go to court with nothng but assumptions and/or accusations its real easy to piss off Judge that way. Go in with documentation, witiness statements and anything you have. Judges seek parents use children all the time for their personal battles with EXs. This is not your case I am saying but it happens a lot so be sure not to make any accusations you do not have some sort of proof on. Drug use is out of question since he has passed a test

I know trust me i learned the first time around with proof. Heck i had 2 restraining orders on this man with proof, a police report and hospital records and still didnt get anything from this judge....Is a journal something that would be allowed i have been keeping one all year....also are you an Attorney? just checking not trying to pry.

Lets put it this way. why would an Attoreny give advice for free he normally charges for? Furthermore even if I or anyone was an Attorney we might not be licensed in your state or work in that area of law! REAL legal advice comes from an Attorney you share an Attorney/Client relationship with. Attorneys (good ones) do not have time to wait for clients to post questions on websites so they can give free advice. If you find an actual Attorney willing to answer your questions I suspect he/she owns website, wants you to hire him/her or, is not very good. IMHO
