Default Child Custody

I have just recently moved to San Antonio i have full legal and physical custody of my son whom is 8 months that is according to me divorce decree from UTAH... i guess my question is....as having full custody what right do i have from keeping my x-wife from geting him.. the situation is a compliated one really because she was only around for the 1st month of his life...and then decided that she wasnt ready to be a housewife and decided that she wanted to be in the party scene rather then a mom. i had given her multiple chances for being around... i moved her back into my home 3 times (seperate rooms) only to receive help from her to raise him in wich all 3 times she never came through for me....i eventually even tried to pay her to watch him because i was working 70+ hrs a week anyway that didnt work so i moved to San Antonio so my family could help me watch him i couldnt afford th daycare....so now im the one who took him away from her .... and now she is intrested because she is getting remarried and trying to have a child...well i do not want to loose my son or even let him go there for awhile untill she proves that she is capable to take care of a child... the last encounter she kicked a window out of my house.....ok well utah gives her visitational rights once he is a little older (unsupervised) currently all must be done in the custodial home and then of course the telephone calls that they say 2 breif phone conversations a week... oh yeah the mom is trying to push that one...however he hasnt learned to talk yet... i would just like to not have any BIG suprise to find out.... i would think texas would be a little more on the custodial parents side... i was disappointed to fint out utahs law.....

Default protective order

dose a protcetive order from another state still have the effect in tx?

Default Full Faith and Credit

Assuming that you are right in all of your assertions about the Utah Order namely that you have legal custody she does not she has limited rights as to visitation and you had the right to move the child across the country here is my answer: You've got nothing to worry about. Obey the Court Order to the letter. When it comes time to litigate again you will register your Order in the state of Texas and the Texas Court will give the Order full faith and credit (pursuant to the U.S. Constitution). I would encourage you not to cut the Mother out of the child's life. Yes I see how she's failed miserably. However that child needs her a million times more than she needs the child. Do you see? The CHILD will be the one ultimately damaged by not having a mother. (not vice versa). Read any book on the point. You're fortunate to have family to help you. I wish you the best of luck. I'll say a prayer for your little one. Please don't let your anger toward the mother rule your decision-making as to the child now or in the future. Rita M. Boyd Attorney
