Unhappy Child Abandonment in MS

Hey everyone I have a 3year old lil boy and am married now for a year and a half. My sons biological father isnt on the birth certificate and hasnt been in his life for 2 years and the first year was on and off. My husband wants to adopt him but Im afraid my ex is going to try and fight it even though my son doesnt even know him. He was abusive toward me so i left and I did try letting him see my son but he kept canceling and wrote me two bad checks for child support and then just didnt hear from him. I do talk to his family and they still see my son and they have said they will b on my side when it gets down to it cause my son doesnt deserve their son as a father. Help pls does anybody know laws on this kind of thing????

Legally he has no Father. However if your husband wishes to adopt you will have to establish paternity with bio Dad and then ask him to agree to TPR termination of parental rights. If he does not your sunk. However you might add that once he becomes child's legal Father you can seek child support including arrears. This might make signing TPR look sweeter to him
