Default Charging 2 tenants for the same apartment

We moved out of our apartment on 01/28/2011 due to excessive noise from our upstairs neighbors. From Sept 2010 we hade complained to our leasing company via email as well as in person. We called the police on the neighbors and filed a police report. The noise did not stop. After numerous complaints we were allowed out of our lease with no penalities. We were told we just have to pay for the month of February even though we moved 01/28/2011, and we had to turn in our keys. We have since found out from our former neighbor that the leasing company has rented the apartment as of 02/10/11. Is it legal to charge two tenants for the same apartment?

I did browse per your reply and did not find anything on my question. I also searched for an Attorney in lawinfo, and have not recieved a call back from anyone.

I sent an email to the Apartment Manager regarding charging 2 tenants rent for the same unit, and now she is telling me we are being charged for breaking our lease. Now she is telling me on the phone, so I requested that she send me that information in writing as I have a letter on Company letter head stating we are not pentalized for breaking our lease, and emails with that same verbiage.

Also I noticed that we have been charged utilites from 2009, that we never agreed to pay in our lease agreement. In August when I noticed and brought it the attention to the Manager at that time, she stated that we should've signed and addendum to be charged the utlities. We never signed the addendum.

You certainly can not pay it and they will need to decide whether or not to sue you. If you already paid it, you will need to decide whether or not you want to take them to small claims court.
