Default Car repo Inquiry

I had a car reposesed in 2004/2005 time frame. On my credit report it shows a a charged off account and another debt collection agency bought the account. I received a letter from this agency stating that i owe them the amount that was charged of plus interest, i don't understand how i owe the amount that was charged off when they stated that the car was sold. I asked for documentation showing that the car was purchased and how much it was purchased for , i also asked for a copy of the purchase agreement for the original creditor, documentation that was obtained from the original creditor in reference to the account and a break down of where they are getting the amount from that they are saying i owe. I have sent 2 certified letters to this agency asking for this documentation they sent me a notice to set up a payment plan after the first letter, they sent me a debt validation from their company on their letter head( which is not what i requested) I informed them on the second notice that after the third letter i send that i will be filing suit with an attorney for harassment and failure to provide documentation showing that the debt is owed to this company and where they came up with the figures. Does it sound like im going about this the right way and what else should i do?

Sounds like a frustrating situation. Just want to confirm - you have an attorney helping you?

Not at the moment but i will be seeking one, i was reading up on collections on the internet and was told i have the rights to the documents i requested and if i was not provided with the requested information i can sue for harrassment

Glad to hear you'll be contacting an attorney. An attorney will be able to advise you regarding the law on debt collection for this tpe of debt and whether any laws have been violated in your situation. Good luck!
