Default Car Dealership Fraud

I purchased a car last year and while doing so i had a trade in. I sat there went through all the crap of getting financed, they said they had a deal. I signed the papers and was on my way out the door with my new truck. About 3 weeks later and my temp tag almost expired i called and asked what was up, they said the financing fell through. So i went back up to the dealership and they tried to get me to sign a new contract with a higher intrest rate and higher payment than origanially agreed. I said uhhhh no, give me my trade in back. They back peddeled and crap, so they said they would make it right. Oh they did alright, i went to refinance my other car through the bank i have this loan through because it is a smaller bank, I have chase right now BLAH!!! Well come to find out the dealership told the bank i made $1000 more a month than what i actually make to get the deal to go through and make my debt to income ratio a better match so the financing will go through. So now almost a year later after borrowing from ppl on some months i find out i cant afford this truck. Do i have a case to sue the dealership or rather voluntary repo the truck and fight it out in court and not get hit on the remainder of the balance since it was the dealership that lied to the bank about my income. If the bank would have known what i really made they would have denied it too, due to debt to income ratio and the dealership would have said sorry we cant finance you it is just not possible.

You are going to have a hard time proving that they were the ones who lied about your income. You certainly can speak with the police regarding this as fraud is a criminal issue. As for a volutary repo, you would still owe the difference left on the loan after the car is paid.
