Exclamation This cannot be legal- Salary to hourly

I am a little irked at thi point so please bare with me. I have worked with my empolyer since February of 2008. Starting out we were all hourly employees, $11.00 per hour. After our 90 day evaluation we were all placed on Salary of $28,000 per year. We were all working overtime and would make up time if we were late or sick. We sat down with the operations manager when she started docking us days if we were out of the office- eventhough we were making up the time and/ or working at home, or coming in on the weekend. We made her aware that what she was doing was illegal and demanded payment for all of our overtime. That was last week. Not a single one of us have been paid our overtime and now we are being forced to sign a new employment contract, with crazy restrictions. We were also notified last night after our work day we were all going to be moved to an hourly rate, instead of our salary. The holidays were were supposed to be paid for are now being taken away. Can they do this? None of us have signed the "new" Contract. PLEASE HELP US!

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.

Default California Overtime rights

In order to be classified as exempt from overtime, you have to meet the test of one of the exemptions. You can contact our or the local labor commissioner to find out if you have legal rights to overtime wages.
