Can an ex spouse collect deceased spouses retirement? Or 1/2? Married 15 years to 1st wife, 2 kids and nothing in the divorce agreement about her getting any of his pension when he retires. Now he's passed away and 2nd wife of 20 years is told she now has to share his retirement with the 1st? So what's the point of putting this in the divorce agreement if she's going to end up getting 1/2 of it anyhow?
