Cabinets Purchased, Not like display, want refund
I purchased some cabinets for my home, and after being told that the wait would be 8 weeks, they have only delivered a portion of the cabinets I ordered. What was delivered is not as described in the display. The main issue with the items is that they were to have a 90 degree edge on the doors with a 1/16th eased edge (basically a softer corner). The display had this feature and the feature is listed as standard in the cabinet specifications book. It was an inportant feature to us. In addition I upgraded to all wood (plywood boxes) and asked for no laminate or pressboard. The toe kicks were to come prepared for my contractor to install toe kick drawers and these were also to come to be installed by my contractor.
In the entire order only two doors/drawers came that did not have damage. The sides of the cabinets and many of the tops are not finished correctly (not sanded and glaze is uneven). The doors/drawers do not have the eased edge feature. The side panels are laminate. The cabinets were not prepared for toe kick drawers and my contractor was asked to rip off the front of the base of the cabinet and install them himself, but the drawers were not delivered. When the bases are ripped off the structure of the cabinet is compromised (the structure includes pieces nailed on the front that hold the base to the cabinet and these have to be removed to remove the front piece). Four of the cabinets look to be carved from chain saws (ok that's an exageration but they're bad). The drawers in these pieces are all different sizes and not flush with the front of the cabinet. The pieces that go between the drawers do not line up when stacked (these four pieces stack on top of each other). The custom pieces did not arrive. Several of the cabinets are not the right size as in the order.
I have worked with the people I purchased the cabinets from and not received what I originally ordered. They now want me to work with the manufacturer, taking them out of the loop. Because the order was wrong, some of the fixes the manufacturer wants to do will make the cabinets not fit in the spaces they have available so they want me to settle for the lesser sides (laminate).
This entire mess is delaying my contracting job. I was to move back into the house this week and had to halt that as we have no kitchen or bathrooms. I don't want to keep working with the manufacturer as it causes additional delays and I have no assurance that the fixes will actually work. I want the cabinets out of my home and a refund of the $15,000 deposit (about 30% of the total cost). My credit card company tells me to take the cabinets back so they can file a claim, but the company won't take them back and says my problems is with the manufacurer not them.
I am ordering cabinets from another dealer so that we can move into our home. This will delay us moving by three months and add additional expenses of about $15000 (added interest since we can't term out our loan and rent for a corporate unit). In addition I have to pay my contractor for the work he's done to install and now remove the cabinets.
I offered to accept a refund and not charge the company for any of my additional expenses if they'd just get the danged cabinets out of my house and refund my deposit. They can then deal with the manufacturer (although part of this is their fault).
They won't take the cabinets. I don't want them and I don't want to keep working with the manufacturer. The items received were damaged, not as ordered and not as shown in their display.
What do I do now? Do I have to keep working with them on these horrible pieces? Many of the things they can't fix are intregal to the design of the new house. What is my recourse? Please help????
