brown recluse spiders in the apartment
in jan. of this year my wife and i moved out of our apartment because of the negligance the management has showed us. we called them 2 times about the problem 4.5 months before we moved out. when we left we took video of the apartment and of the zip lock bag of the spiders i kept as evidence. i even sent them a letter in mail after i moved out certified mail stating as to why i left. now they want to take us to court over 2 months rent. is there a reason they might think they would win this case? the lease stated that if the residence is so injured by fire or other casualty not occuring through my fault and that if the residence can not be repaired within 30 days of such injury that the lease be immediatley terminated and void on the date of such injury. i told them of this twice in 4.5 months time. if it was repairable then why was it not fixed. it says that if it is repairable within 30 days that the Lessor may enter the premises and repair it. So if it was a fixable situation then why was it not fixed. i think that they should be paying me that rent after the 30 days of the first notice i gave them. we told them that the place was over ran with the spiders. should they even try to take me to court knowing this?
