How binding is a listing contract?
Last October, my home was for sale by owner. I only wanted to try myself for a week, so on Oct 20 I signed a listing contract to take effect Oct 27. The house sold before Oct 27. The buyer used a buyers agent from the same company I signed the listing contract. Due in part to the actions of the buyers agent, the sale fell through. I did not want to list with that company, so I kept it for sale myself. My listing agent said he shredded the contract. I'm ready to list the home with a realtor now, but that original contract was in effect until April 27. The listing agent has done nothing - no sign, no ads, not on multi-list - nothing. I am afraid if I do list with an MLS agency before April 27, the original listing agent will cry foul, and maybe even try to get commission if the house sells. He says he shredded the contract, but who knows. Is it safe to list the house, or just wait another month?
