Default Bankruptcy v. Child Support

As a result of my divorce agreement, I was required to pay my wife $275.00/month for settlement of credit card debt. She in return was required to pay me $125.00/month in child support, in effect making my monthly payment to her $150.00. She recently completed bankruptcy and foreclosure on her personal residence. Since she has been discharged from debts, I am still required to pay her $150? If not, am I entitled to receive child support from her?

You are entitled to back to court and ask the judge to make any or all of those changes. If her debt was discharged in bankruptcy, you have an excellent argument that you should no longer be paying off the debt. But until the COURT amends the order, it remains in effect as written, even if circumstances have changed - so get to court as quickly as you can.

I agree with aardvarc. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
