Default Bad Applicance Repair

Hi,

I would like some opinions please. I called a refrigeration company to come and fix my fridge / freezer. After explaining the symptom’s to the company they said it was probably the compressor. They arranged to come out and fix the unit.

After three separate attempts it is still not working. I started to think they didn’t know what they were doing as it is now more broken that when they started. (Parts that were working are now not working).

Because I was losing faith in the company’s ability to fix this I setup my video camera and taped a conversation I had with the technician. On tape the technician stated he had never seen this type of unit before. We agreed to try one more thing and if that didn’t work he would come back and take the parts used and return my parts (that were taken away – without my permission).

This agreement was Video Taped (in secret).

After the final fix did not work, I called the technician and he said he would be out the next day. Later that same day the company owner called me and said I owed them $500. He said that I contracted them to replace the compressor and nothing else. He said that I never asked them to diagnose the problem and it was not their fault. He refuses to return the parts they took from my property.

I NEVER told them what to replace, I hired them to fix the unit, I was solely relying on them to correctly diagnose and fix. They have NOT fixed anything.

I have written to them to demand they return my parts and pickup their parts. They have ignored my demands.

What I really want to know is where I stand legally.
1. I never signed ANY paperwork, there is no written contracts.
2. I have video of them agreeing to return (my parts) and collect (their parts)
3. Can they claim I owe them? They failed to fix and failed to diagnose correctly ?
4. They took parts from my home without my permission (Theft?)
5. I want to return there parts, if they won’t collect them do I mail them? Or are they considered abandoned?
6. Do they have any case?
