Unhappy Back Child Support Issue--HELP!!

My husband went to prison (Not related to child support or children) in 1995. His child support kept racking up. The child got killed in a car accident in 2003. Ex got $100 thousand wrongful death money, when they contacted him because legally 1/2 was his, he said if you give it to me the state will take it, so give it to her and take it off the child support. They gave it to her, BUT did NOT take it off child support. He got out of prison, has paid what he can to her, she found out we got married, made her mad, she called child support, they actively pursued him because $23 thousand of what is against him belongs to them for food stamps, ADC, etc. Ex is broke, went through $100 thousand in 1 year, has nothing to show for it. We had an attorney, paid her $2500.00. ALL she did was make the Judge mad talking about "Statute of Limitations" and crap. She did not even bring up the wrongful death money. Long story short, Judge says you owe it, you pay it. He thinks there are children going without because it is not being paid and we cannot get him to understand different. My husband has been without work, but has been looking. Judge keeps throwing him in jail. The county this is all in is the county that sent him to prison for 15 years of which he served 10 flat. The Judge is from another county, the original one recused himself. Judge only comes every couple of months or so. Husband has to set in jail until he comes back. (In jail now, Judge not back til the end of March) Can he get a change of jurisdiction? I have no money for an attorney. Is it legal for me to write the Judge? We asked her to forgive her part of the child support, but she says no, she needs it. The total is $45,000.00 owed. $23,000.00 to the State and $22,000.00 to the ex. Can anyone tell me anything we can do?

I can understand that this is frustrating for you and your husband, but I really think you need to try to find an attorney. A judge will not read a letter from you since you are not a party to the action. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet?
