Attorney Fees
I have a client whom I have been representing for approximately 14 moths. I filed the intitial application, I filed the Request for Hearing and am awating a hearing date from ODAR. For the past 14 months I have gathered medical evidence which shows this claimant is clearly disabled and I anticipate winning this case. The hearing will most likely be scheduled within the next 2-3 months. I estimate I may have spent 10 to 15 hours working on this client's case.
Recently, this client informed me that they would like to get another attorney to handle this case. I was told they are happy with my reprentation but they feel more comfortable with a woman attorney handling their case from here. The client has requested that I send them a withdraw letter.
Is there anyting I can do to receive attorney fees from SSA if this case is awarded? I have spent many hours working on this case. All the necessary medical records are in place. It seems unfair that another attorney can come in at the last minute, simply show up to the hearing and collect $5,300.00 in attorney fees after I put so much work into this case. Is there any remedy??? Help!
