Default Arizona Interstate extradition law

SO here is the scenario:

My mom is currently an inmate at a federal facility in Arizona. Her release date is set for July 3 but they will not release her because she has active warrants in Colorado. She was put in prison BEFORE Colorado activated their warrants and even though the judge in Colorado has put a bond on those warrants they are saying that she has to be extradited BEFORE we can post the bond for her. So does Arizon state law provide any kind of time frame or time limit in which Colorado has to come and retrieve my mother. If so how long?

I can certainly understand this is a frustrating situation for your mother. Most states do have a time period, but this is a federal prison so they follow federal law. I suggest you contact an attorney to determine her legal options. You can find an attorney through the locator service on LawInfo’s home page at: http://www.lawinfo.com/.

You can also browse through the information in LawInfo’s Free Legal Resource Center here: http://www.lawinfo.com/index.cfm/fus...lient.consumer, or search for your particular topic here: http://resources.lawinfo.com/index.html.

Default Arizona Interstate extradition....likelihood?

I would like to know the likelihood...and distance considerations that one could guestamate regarding Cochise County Arizona's willingness to extradite on a felony drug-related warrant.

More specifically: is there some kind of distance that would decrease the likelihood of the county's desire to extradite from another state?

Second question:

Are police officers in other states privy to outstanding felony warrants that are out of state from their patrol car on the highway...or must they arrest you and take you into custody to find out such information?

Whether they extradite or not will be determined by the specific office policy. Typically states/counties do extradite on felony warrants. The cost is passed on to the defendant if convicted as part of court costs. Some police will have access to warrants, others will not. Depends on the system that is in place in their car, county, etc. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
