Default Apartment Lease Agreement

Hello Everyone! I have an emergency situation regarding a Lease Agreement that I signed on Thursday, March 15, 2007. I was pressured into putting the deposit down, which was $250.00 and signing the lease by the Property Manager. She called me three times (at work) stating they had another application on that apartment. The next day not even twenty four hours later, I informed her that I have not taken possession of the apartment and I want to cancel the lease and get my deposit back. She stated that I was not able to cancel and I would have to buy out of that lease for $2800.00. I was under pressure and duress when I signed the lease and she was aware of that and took full advantage of me. Now, I need help getting out of this lease...I am thinking of returning the keys as I have not yet taken possession of that apartment...Please help..

You may want to post this under landlord/tenant. I would check out your state's renter's rights. Was the apartment putting you under duress or was it another source?

did anyone find out if this situation was helped?? cuz it seems the original person who started the thread didn't post anymore after this. I have the exact same situation that happened to me and I was looking for some information because the landlord and tenant act wont help me because i haven't moved in or received the keys. they dont help pre tenants they told me. Small claims court is supposedly the only way i have to go. I was mislead completely on what was going on and I wasn't even given a copy of what was signed. i have asked for it three days ago and was told i would get it three days ago. every time i have called in the past two days i have gotten the response, i will send it tomorrow. today she has told me that it will be coming today. Also i am in windsor ontario currently. the Unit was to be in woodstock ontario, two hours away. so neither city will help me with this!!
please help!!!

Just to clarify - you signed a lease for a residential unit and paid a deposit, but you haven't received keys or moved in yet? When is the move-in date?

Default Sign a 1 year lease. Have not taken possesion yet, but I want out. Please help

Hi,

I signed a 1 year lease for an apartment on June 16, 2008. I have put a deposit and first month's rent. I called the owner the next day and told him that I changed my mind. He responded by saying that the lease is my responsibility. The move in date is July 1, 2008. I have not taken possession of the apartment yet. Is there a way I can get out of the lease? Please help.

You would need to read your lease and see if you can sublet it. Otherwise you are pretty much stuck with it. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own.
