Adviced Needed about supposed expungment and...
In 1-04 I was arrest for growing and distributing marijuana. Even though I know there was illegal methods used to arrest me I accepted a pea of deferrment sicne my public defender told me that after 3 years of succesful probation my charges would be "expunged"...my record would be "wipped clean". Ya right! Now that I am nearing the end of my probation and persuing a professional career I have done a bunch of online research and found out that as far as the job market and professional licenses (teaching nursing accounting etc) not only will my charge not be expunged but it will be considered a conviction forever! I agreed to a plea based on a huge lie! I feel devestated and angry. #1) Can I take back my original agreement / plea based on being given false information by my own public defender? #2)The law enforcement used an illegal practice to lead to my arrest and then claimed the wire recording had malfunctioned (knowing that their case could be ruined by their own recording). I feel tha if I could go back and have a real trial for the original charges and put people on the stand etc I could get my charges dismissed. IS THERE ANYWAY I CAN TAKE BACK MY PLEA??? This seems like fraud by the state the way they conveniently get me to accept a plea by planting a rosey future in my head and later I find out it is all a lie. Why should they care? Law enforcement looks good - the court looks good the prosecuter looks good and the public defender looks good. They all conspire for their own benefit while my life is ruined! While the big alcohol and tobacco companies make millions based on products that kill millions my life is ruined over peacefully growing plants that never hurt anyone nearly as much as legal drugs with financial ties to the state! Crimes are only crimes until the state benefits - just like gambling. ANYWAY - is there any justice any more????
