Default adoption

We are interested in adopting an 11 year old girl named Ashlee. Her mom will have the final hearing that will determine her fitness as Ashlee's mom this December 2007. It doesn't look good and I believe that Ashlee and her 2 siblings will be up for adoption at that time. Her brother is 1 yr. and her sister is 8. I believe that both of the sibling's seperate foster families wish to adopt them as well.

If Ashlee's mom's rights are terminated, then Ashlee's Aunt Joy (mom's sister) has promised Ashlee to try to adopt all 3 kids. Joy has 3 kids of her own and a fourth on the way and is not married. Ashlee's mom and mom's 2 sisters come from a sexually abusive home and they are very unstable. We are concerned and bothered by the idea of Ashlee returning to anyone in that family. I don't know Joy's financial situation, but I know that they are poor. Ashlee's mom lives with Joy and their plan is that if Joy adopts the kids, then they will all live together and it will be as if nothing ever happened. They also plan on moving to Texas as soon as the adoption would be final and live as one big happy family.

Do you think the court's would award Joy the right to adoption in this matter? We are nervous about stepping in and voicing our interest in adoption because if we won, Ashlee would resent that we stepped in and prevented her from returning to her family. We feel like we should just sit back and see what happens. But we are very curious as to whether Joy has any chance of adopting these kids.

You may want to post this under family law as well. As for what will happen, it is hard to tell without knowing all of the facts. Are you a relative?

Well, we are officially Ashlee's god parents. That is how we were able to take them in to our home as foster kids initially. We were listed as family at that time.

Legally being a god parent doesn't really mean anything. I would suggest that you speak with an attorney to discuss your legal options. He or she can best help you decide the best course of action. Moderator has mentioned the correct thing! Post this one in Family Law section. So that you can get good and appropriate response from other members. And one more thing I would like to suggest is that take help of a attorney. It may leads you in a good way.
